This Privacy Statement explains how Septilink Inc. (“Septilink”, “we” or “us”) collects, uses, discloses and safeguards the data collected about you, including information we collect when you use our products and services, when you contact our customer service team, engage with us on social media, and when you otherwise interact with us.

When we refer to our “Services” in this statement, we mean our websites (including septilink.com , portal.septilink.com ), apps and other online services. When we mention “Products,” we mean Septilink-branded hardware Products, including our SL-3, SL-4, SL-5, SL-6, and SL-7.

We may update this Privacy Statement from time to time. If we make changes, we will notify you by revising the date at the top of the statement and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification). We encourage you to review the Privacy Statement whenever you access the Services or otherwise interact with us to stay informed about our information practices and the choices available to you.

COLLECTION OF INFORMATION

The information we collect about you depends on how you interact with us or use our Services. In this section, we describe the categories of information we collect and the sources of this information.

Information You Provide to Us

We collect information you provide directly to us. For example, we collect information directly from you when you create an account, fill out a form, submit or post content through any interactive features of our Services, make a purchase, communicate with us via third-party platforms, participate in a contest or promotion, volunteer as a product tester, request customer support, respond to a survey, or otherwise communicate with us. The types of information that we collect include your:

  • name

  • email address

  • postal address

  • phone number

  • username

  • photographs (such as for your profile picture)

  • social media profile information

  • location information such as global positioning system (GPS) data to determine where Services and requests should be fulfilled

  • any other information you choose to provide

If you make a purchase, we work with a third-party payment processor to collect and process your payment information. 

Some of the information we collect is considered “sensitive” under some laws. For more information and to exercise your related choices, see the Your Privacy Rights and Choices section below.

Telematics We Collect on Specific Products 

Septilink sells some products that use, record and provide telematic data. This data is primarily used for service and warranty purposes.

Automatically Collected Information and Information We Generate

When you use our Services, we automatically collect or generate certain information about you as follows:

  • Our Services will collect various Device Log and Sensor Information: Device event data, such as when the Device is used, whether it is turned on or off, electrical current draw, air pressure, location of the device, or other sensor data.

  • Activity and Usage Information: When you use our websites and mobile apps, we collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type, and app version. We also collect information about your activity on our Services, such as access times, pages viewed, links clicked, and the page you visited before navigating to our websites.

  • Transactional Information: When you make a purchase, return or warranty claim, we collect information about the transaction, such as product details, purchase price, and the date and location of the transaction.

  • Information Collected by Cookies and Similar Tracking Technologies: We use tracking technologies, such as cookies, pixels, and SDKs to collect information about your interactions with the Services. These technologies help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Additionally, when you interact with our Services, we and our online data partners or vendors may use cookies, pixels, ad beacons and similar technologies to associate these activities with information they or others have about you (including your email address).  We (or service providers on our behalf) may send marketing and other communications to these email addresses. Information We Collect from Other Sources

We may obtain information about you from other sources. For example, we may collect information from publicly available sources, from third-party platforms through which you interact with us, and other third parties in connection with your purchase of or feedback regarding any of our Products or Services via those third parties. This information includes information about your purchase of a Device, information from reviews you post, your username and profile picture for those third-party services, and demographic information.

USE OF INFORMATION

We use the information we collect to provide, maintain, and improve our Products and Services. We may also use the information we collect to:

  • Process and fulfill your purchases;

  • Personalize your experience with us;

  • Develop new Products and Services;

  • Improve our Products and Services, including by using information to improve or develop new algorithms, models, and/or machine learning technologies; 

  • Send you technical notices, updates, security alerts, and support and other transactional or relationship messages;

  • Communicate with you about Products, Services, and events offered by Septilink and others, and provide news and information we think will be of interest to you (see the Your Privacy Rights and Choices section below for information about how to opt out of these communications at any time);

  • Monitor and analyze trends, usage, and activities in connection with our Products and Services;

  • Comply with our legal and financial obligations;

  • Detect, investigate and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and help protect the rights and property of Septilink and others;

  • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards;

  • Create de-identified, anonymized, or aggregated information; and

  • Carry out any other purpose permitted by applicable laws or regulations. .

DISCLOSURE OF INFORMATION

In certain circumstances, we disclose (or permit others to directly collect) information about you. We disclose the information about you described above in the following ways:

  • With vendors, service providers, and contractors that need this information to provide services to us, such as companies that assist us with web hosting, shipping and delivery, payment processing, fraud prevention, customer service, and marketing and advertising;

  • If you provide a product review or otherwise post content on our Services, the public/other users of our Services will be able to see this information.

  • In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;

  • If we believe your actions are inconsistent with our user agreements or policies, if we believe you have violated the law, or to protect the rights, property, and safety of Septilink or others;

  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;

  • Between and among Septilink and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and

  • With your consent or at your direction. For example, if you choose to integrate our Products or Services with third-party services (such as voice assistants), then those services will collect certain types of data depending on the nature of the service. Please review their privacy policies for details on the information they will receive and how they process this information.

We may disclose aggregated or de-identified information that cannot reasonably be used to identify you. Septilink processes, maintains, and uses this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

We do not lease, rent, or sell facial data or data that could be considered biometric information under applicable laws. 

YOUR PRIVACY RIGHTS AND CHOICES

Account Information

You may update and correct certain account information at any time by logging into your account on the Services. If you wish to delete your account, navigate to your profile settings on the Services. Note that we may retain certain information as required by law or for our legitimate business purposes. Deleting your account may not interrupt on-going contractual agreements between you and your service provider. Contractual agreements between you and Septilink will be governed by the Terms and Conditions found at http://septilink.com/terms and the terms of the contractual agreement.

Opting Out of Targeted Advertising, Sharing, and Sales

We process personal information to understand and improve your experience with our Services and to serve you advertisements on non-Septilink properties. Some of these activities may be considered “sales” or “sharing” of your personal information or “targeted advertising” under the law that applies to you.

Depending on where you reside, you may have the right to opt out of targeted advertising, sharing, and sales of your personal information. You can do so by following the prompts on our website.

Consent, Objection, and Related Rights

Depending on where you reside, you may have the right to object to certain processing, withdraw your consent where we process your information on that basis, and the right to request we restrict certain processing. To exercise any of these rights, please email us at optout@septilink.com.

Nondiscrimination

We will not discriminate against you for exercising your privacy rights.

Location Information

When you first launch our mobile app, you will be asked to consent to the app’s collection of precise location information. If you initially consent to our collection of such location information, you can subsequently stop the collection of this information at any time by emailing optout@septilink.com. If you do so, our mobile apps, or certain features, may no longer function properly. You may also stop our collection of this information by deleting our app from your mobile device.

Cookies

Septilink uses cookies and similar tracking technologies to analyze visits to our websites and interactions with our communications to help us improve our website, Services, and marketing campaigns. Most web browsers are set to accept cookies by default. If you prefer, you can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of our Services.

Promotional Emails

You may opt out of receiving promotional emails from Septilink by following the instructions in those emails or by contacting us at optout@septilink.com. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.

Text Messages

If you want to opt out of text messages sent to your mobile device, including promotional or non-promotional text messages, you can reply “STOP” to any message you receive.

Mobile Push Notifications/Alerts

With your permission, we may send push notifications to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.

DATA RETENTION

Account Information

We store personal data associated with your account in accordance with our internal record retention policy or as long as required to comply with state or federal law. We can provide you with the relevant section of that policy upon request.  We store other personal data for as long as necessary to carry out the purposes for which we originally collected it and for other business purposes explained in this Privacy Policy. 

 

TRANSFER OF INFORMATION TO THE U.S. AND OTHER COUNTRIES

Septilink is based in the United States and we process and store information in the United States and other countries. Therefore, we and those that perform work for us may transfer your information to, or store or access it in the United States or jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction.

This California Privacy Statement (the “CA Statement”) supplements the main Privacy Statement and provides additional details on how Septilink, Inc. (“Septilink,” “our,” “we,” or “us”) collects, uses, and discloses the Personal Information of California residents who interact with Septilink as an employee, owner, director, officer, or independent contractor of another company, partnership, sole proprietorship, or government agency (each an “Entity” and collectively “Entities”). This Statement also explains your rights relating to Personal Information under the California Consumer Privacy Act, as amended (the “CCPA”). We use the words “you” or “your” to refer to anyone within the scope of this CA Statement. In the event of a conflict between any other Septilink policy, statement, or notice and this CA Statement, this CA Statement will prevail as to California residents’ rights under the CCPA. This CA Statement applies to Personal Information we Collect about you when you interact with Septilink or manage one of our products or Services as the representative of an Entity that is a Septilink customer. While it may be informative regarding such Services, this CA Statement does not convey rights relating to Personal information under the CCPA for data processed by Septilink in connection with Services Septilink provides as a service provider.

Unless otherwise noted, the Information Practices below describe our current practices and our practices for the twelve (12) months preceding the Effective Date.

What Personal Information We Collect and Why We Collect It

We Collect Personal Information as follows (whether we Collect a specific category of information depends on the nature of your interaction with us):

We do not Collect Sensitive Personal Information for the purpose of inferring characteristics about you. We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.

Sources of Personal Information

We collect the Personal Information identified above from the following sources (whether we collected it from a specific source depends on the nature of your interaction with us):

  • Directly from you. We collect Personal Information from you when you provide it to us, such as in connection with a transaction, while interacting with our Website, when you call us or our call center, or while providing information in response to a survey. As indicated above, Septilink may also utilize global positioning system (“GPS”) software, geo-filtering, original equipment manufacturer (“OEM”) telematics embedded hardware and cloud platform software for data collection and data management, and other location-aware technologies to locate users (sometimes precisely), for purposes such as verifying a user location and delivering services. If a user or fleet owner customer has enabled GPS or other location-based features through the Services, the device location may be tracked by us and third parties.

  • Automatically when using our digital services or visiting our premises. We collect Personal Information about you when you use our information technology services, including our websites. Please see our general Septilink Privacy Statement, above, for additional details.

  • Created by us. We collect Personal Information about you that we create, such as credentials for access to our information technology systems, or inferences generated from other information we collect.

  • Service Providers. We collect Personal Information about you from certain Service Providers that provide information to help us run our business.

  • Affiliates. We share Personal Information among the companies within the Septilink family of companies and affiliates. We receive information within this “family,” as permitted, to enable us to manage our business and workforce.

  • Law enforcement agencies, courts, regulatory agencies, and other government agencies. We may receive information from government agencies to comply with the law, to protect your personal safety or the safety of others, to protect our or others’ rights, or to investigate fraud.

  • Other parties. We may receive information about you from other parties when necessary to manage or operate our business. For example, in litigation settlements we may collect information about you from third parties related to our operational or tax reporting obligations.

  • Parties to corporate transactions. As permitted by law, we may receive Personal Information as part of a corporate transaction or proceeding, such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of a business or assets.

Disclosures of Personal Information

This section describes the categories of Personal Information Sold to Third Parties or Shared with Third Parties for Cross-Context Behavioral Advertising in the preceding twelve (12) months. We offer you the ability to opt-out of these disclosures as set forth in the “Right to Opt Out of Sales and Sharing of Personal Information” Section below.

We may Sell and/or Share with Third Parties for Cross-Context Behavioral Advertising the following categories of Personal Information:

  • Identifiers

  • Internet or other electronic network activity information

  • Geolocation data

We Sell and/or Share this Personal Information for advertising purposes to Third Parties. The Third Parties to whom this Personal information was Sold and/or Shared are advertisers and analytics vendors.

We do not knowingly Sell the Personal Information of minors under sixteen (16) years of age.

We also disclose the Personal Information described in this CA Statement to Service Providers that help us run our Business. We also may disclose the Personal Information described in this CA Statement in other circumstances when required to or permitted by law. These circumstances include:

  • Disclosures among the companies and affiliates within the Septilink family of companies and affiliates, when permitted by law;

  • Disclosures to other parties to provide products or services requested by you;

  • Disclosures to parties when required or permitted by law to defend against legal claims;

  • To law enforcement agencies, courts, regulatory agencies, and others when the disclosure is required or permitted by law, including to comply with valid legal process; and

  • To parties in a corporate transaction or proceeding, such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of our business or assets.

How Long We Keep Your Personal Information

We keep the categories of Personal Information described above for as long as is necessary for the purposes described in this CA Statement or otherwise authorized by law.

This generally means holding the information for as long as one of the following criteria apply:

  • Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;

  • Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was Collected;

  • The Personal Information is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or

  • We are otherwise required or permitted to keep your Personal Information by applicable laws or regulations.

Where Personal Information is used for more than one purpose, we may retain it until the purpose with the latest period expires. For more information about our retention policies, please contact us using the contact details below.

Submitting Requests Relating to Your Personal Information

If you have an account with Septilink, you may manage your account, including accessing, deleting, or correcting certain Personal Information we have about you, by contacting us at support@septilink.com.

If you are a resident of California, you also have the right to submit certain requests relating to your Personal Information as described below. To exercise any of these rights with respect to the information covered in this CA Statement, please submit a request by emailing us at support@septilink.com. Please note that, if you submit a request to know, request to delete, or request to correct, you will be asked to provide two-to-three (2-3) pieces of Personal Information that we will match against our records to verify your identity. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using the email address listed above.

Right to Know. You have the right to know what Personal Information we have Collected about you, which includes:

  • The categories of Personal Information we have Collected about you, including (a) the categories of sources from which the Personal Information was Collected; (b) our Business or Commercial Purposes for Collecting Personal Information; (c) the categories of Third Parties to whom we disclose Personal Information; (d) the categories of Personal Information that we Sold or Shared, and for each category identified, the categories of third parties to whom we Sold or Shared that particular category of Personal Information; and (e) the categories of Personal Information that we disclosed for a Business Purpose and the categories of Third Parties to whom we disclosed each category of Personal Information.

  • The specific pieces of Personal Information we have Collected about you.

Right to Delete Your Personal Information. You have the right to request that we delete Personal Information we Collected from you, subject to certain exceptions.

Right to Correct Inaccurate Information. If you believe that Personal Information we maintain about you is inaccurate, you have the right to request that we correct that information.

Right to Opt Out of Sales and Sharing of Personal Information. You have the right to opt out of the Sale of your Personal Information, and to request that we do not Share your Personal Information for Cross-Context Behavioral Advertising. You may opt out of Sales or Sharing via cookie or tracking technologies by clicking on the “Cookie Settings” link in the footer of our websites and interacting with our cookie preference center. We have also enabled the Global Privacy Control (“GPC“), which is designed to recognize opt-out preference signals. In order to process your request through an opt-out preference signal, you must use a browser or extension supporting the preference signal. If you choose to use an opt-out preference signal, you will need to turn it on for each browser and each device you use. If you would like to opt out of Sales and Sharing other than through cookies or other online tracking technologies, you can do so by emailing us at optout@septilink.com.

Right to Non-Discrimination for the Exercise of Your Privacy Rights. If you choose to exercise any of your privacy rights under the CCPA, you also have the right not to receive discriminatory treatment by us.

11. Notification of Changes to Privacy Statement

We will update this Statement when necessary to reflect changes in applicable law, our Services or products, what Personal Information we collect, or how we use Personal Information. When we post changes to the Statement, we will change the “Effective Date” at the top of the Statement.
